PRIVACY INFORMATION EX ART. 13 REG. EU n. 2016/679
Information pursuant to article 13 of Legislative Decree 196/2003 and of art. 13 and 14 of EU Regulation no. 2016/679.
OBJECT: Pursuant to 13 of EU Regulation no. 2016/679 (hereafter “GDPR 2016/679), which protects persons and other subjects to the processing of personal data, is to be informed that the personal data provided by you will be processed in compliance with the aforementioned regulations and L obligation of confidentiality referred to by the “Puglia e Pedala” Company of Lozito Daniele.
HOLDER OF THE TREATMENT: The data controller is the company Individual “Puglia e Pedala of Lozito Daniele”, based in Bari, Via Gentile n. 72, chap 70126, VAT number 08144130724, in the person of the Legal Representative Mr. Lozito Daniele (C.F. LZTDNL81D23F205G)
PURPOSE OF THE TREATMENT: The data supplied by you are necessary for the fulfillment of the requested / offered cycling cycle service.
PROCESSING AND STORAGE MODALITIES : The processing is carried out through operations, performed with or without the aid of electronic tools and consists in the collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and data destruction. The treatment is carried out by the owner and by the specifically authorized agents, in compliance with the provisions of art. 32 of the GDPR 2016/679 and in compliance with the provisions of art. 29 GDPR 2016/679.
Please note that, in compliance with the principles of lawfulness, purpose limitation and data minimization, pursuant to art. 6 GDPR 2016/679, your personal data will be kept for the period of time necessary to achieve the purposes for which they are collected and processed and in any case not exceeding 10 years.
1. TYPES OF DATA WE COLLECT
We collect three general categories of data.
1.1 Information you provide directly to us.
1.1.1 Information necessary for using the platform / service
When you use the Platform / service, we request and collect the following personal data. This information is necessary for the proper execution of the contract between us and the Customer, and enable us to act in accordance with our legal obligations. Without this data, we may not be able to provide you with all the required services.
- Registration and / or Account Data : When you enter the site or register a new account, we ask you to provide some data such as your name and other, email address and birth data.
- Profile data: To use certain features of the Platform / service (such as booking) we may ask you to provide us with additional information including your address, telephone number, email address and country of residence.
- Other authentication information: To help create and maintain a reliable environment, we may collect identification data (such as a photo of your ID, passport or driving license, if permitted by applicable law) or other authentication information.
- Payment information: To use certain Puglia e Pedala features (such as booking), we may ask you to provide some payment information (such as your bank account details or credit card details) to facilitate payment processing..
1.2 Optional information that you may provide to us
You can choose to provide us with additional personal information to improve your user experience on the Platform. These additional data will only be processed with your CONSENT.
Additional profile data. You can choose to provide additional information (such as gender, preferred language (s), city) and your personal description
other information. You can also choose to provide us with other information when you fill out a form, do a search, respond to surveys, participate in promotions or use other features of the Platform, including the portrait contained in the photographs that may be taken during promotional activities and illustrative of the course carried out for the purposes strictly connected and instrumental to the activities as indicated. The conferment of consent to the processing of personal data is optional.
1.3 Information necessary for the use of the Payment Services
In order to comply with the applicable law (such as for example anti-money laundering regulations) and to fulfill the contractual obligations adequately, the Payment Processing Controller needs to collect the following information, without which you could not use the Payment Services
Payment information. When you use the Payment Services, the Payment Processing Controller requires some payment information (such as your bank account details or credit card details) to process payments and comply with applicable law.
Authentication information and other information. The Data Controller may request an identity check (such as a photo of your ID, passport or driving license if permitted by applicable law) or other identifying information, such as your date of birth, address , the email address, telephone number and other data to provide you with the Payment Services and comply with applicable law.
1.2 Information we collect automatically from the use of the Puglia e Pedala Platform and the Payment Services.
When you use the Puglia e Pedala Platform and the Payment Services, we automatically collect information, including your personal data, regarding the services used and the method of use. This information is necessary for the proper execution of the contract between us and the user, to enable us to act in compliance with our legal obligations and on the basis of our legitimate interest in being able to improve and to offer you the functionality of the Puglia Platform and Pedala and Payment Services.
Log data and device informationWe automatically collect. Log data and device information when a user accesses and uses the Platform, even if he has not created an Account or is not logged in. This information includes, among other things: information on how the user has used the Platform (including links to third-party applications on which the user has clicked), IP address, date and time of access, information on hardware and software , information about the device, information about the events concerning the device, unique identifiers, crash data, cookies, and the pages viewed by the user before or after using the Platform.
Transaction information. Puglia e Pedala collects information related to your transactions on the Platform, including the payment instruments used, the date and time, the amounts paid, the payment instrument expiration and the billing address of the user, the address e-mail connected to the PayPal account, the IBAN, your address and other details related to the transaction. This information is necessary for the proper execution of the contract between us and the user and to allow the latter to use the Payment Services.
3 Information we collect from Third Parties.
Puglia and Pedala may collect data, including your personal data, that third parties provide about you when using the platform and the Payment Services, or obtain information from other sources and combine it with the information we collect through the Platform and Payment Services. We do not control, supervise or respond to the processing of your personal data by such third parties, therefore any request for information regarding the communication of your personal information must be forwarded directly to such third parties.•
- Third party services. If you connect, connect or access the Platform with a third-party service (eg Google, Facebook, Instagram), this tool can send us information such as, for example, your registration data and your user profile on that service. The data sent to Puglia e Pedala vary and are controlled by this service or depend on the authorizations you have issued to this service in the related privacy settings.
- Other sources. To the extent permitted by applicable laws, we may receive additional information concerning you, including, for example, demographic data or fraud detection information, from service providers and / or third-party partners and combine them with the information in our possession. For example, we may receive results of background checks (upon your CONSENT when required) or fraud reports from industry service providers, such as identity verification companies, in line with our fraud prevention efforts and risk assessment. We may receive information about you and your activities on the Platform or outside of it by virtue of partnerships, or about your experiences and interactions from our partners and our networks.
2. SHARING AND COMMUNICATION
2.1 Scope of communication and dissemination
We also inform that the collected data will never be disclosed and will not be communicated without your explicit consent, except for the necessary communications that may involve the transfer of data to public bodies, consultants or other subjects for the fulfillment of legal obligations .
Where you have given your CONSENT, we may share your data, including personal data, as described when we obtained your consent, for example when you authorize an application or a third-party website to access your Account, or when you participate in promotional activities conducted by partners of Puglia e Pedala or third parties.
2.2 Profiles and other public information.
Based on our legitimate interest in promoting the Puglia and Pedala Platform, we could show parts of it on sites of business partners.
The data you share publicly on the Puglia e Pedala platform can be indexed by search engines not managed by Puglia and Pedala. If you change your settings or your publicly accessible content, these search engines can not update their databases. We do not control the practices of third-party search engines and these may use cache memories containing data that are not current to you.
2.3 Compliance with the law, response to requests from public authorities, prevention and protection of our rights.
Puglia and Pedala and may communicate your data, including personal data, to courts, public authorities, governmental authorities or third parties authorized in the case and to the extent we are required or authorized to do so by law or if such communication is reasonably necessary : (i) to comply with our legal duties (ii) to comply with a legal procedure and to respond to claims made against Puglia and Pedala, (iii) to find verified requests related to a criminal investigation or alleged or supposed illegal activity or any other activity likely to expose Puglia and Pedala, yourself or any of our users to legal liabilities, (iv) to manage and enforce our Terms of Service, the Terms of Payment or other agreements with Members, ( v) to protect the rights, property or personal security of Puglia and Pedala, its employees, its Members or the general public.
2.4 Aggregated data.
We may also share aggregated data (information about our users that we combine together so that they do not identify or are referable to a single user) and other anonymous information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other commercial purposes.
TRANSFER OF PERSONAL DATA
Personal data may be transferred to countries of the European Union or to third countries not belonging to the European Union or to international organizations, within the aforementioned purposes. It will be communicated to the interested party whether or not an adequacy decision of the European Commission exists.
EXISTENCE OF AN AUTOMATED DECISION-MAKING PROCESS, INCLUDING THE PROFILING.
Puglia e Pedale does not adopt any automated decision making process, including profiling, as per art. 22, paragraphs 1 and 4, of EU Regulation no. 2016/679
You can exercise all rights described in this section, ex. Article 7 of Legislative Decree no. 196/2003 and articles from 15 to 22 of EU Regulation no. 2016/679, against the Data Controller, by sending an email to the following address: pugliaonbike.com.
a )Data management.
You can access and update some of your data from your account settings. If you have chosen to link your Puglia e Pedala account to a third-party application, such as Facebook or Google, you can change the settings and remove the app’s permission. You are responsible for updating your personal data.
b) Correction of inaccurate or incomplete information.
You have the right to request to correct inaccurate or incomplete personal data concerning you (and which you can not update yourself).
c) Portability and access to data.
The applicable law allows you to request copies of personal information in our possession. Furthermore, you may be entitled to request copies of personal data that you have provided us in a structured format, commonly used and readable electronically, and / or request that we transmit this information to another service provider (where technically feasible).
d) Storage and deletion of data.
In general, Puglia e Pedala keep your personal data for the time necessary to execute the contract stipulated with you and to fulfill our legal obligations. If you no longer wish that Puglia e Pedala use your data in order to give you access to the Puglia and Pedala Platform, you can ask us to delete your personal information and close your Puglia e Pedala account. We remind you that if you decide to request the deletion of your personal data:
- We may retain some of your personal information for the time necessary to satisfy our legitimate business interests, such as fraud prevention and detection and security promotion. For example, if we suspend a Puglia and Pedalaper account for fraud or security reasons, we may retain some information from that account to prevent the same Member from opening a new Puglia and Pedala account in the future.
- We may retain some of your personal information to the extent necessary to fulfill our legal obligations. For example, we may retain some of your data for tax obligations, reports and legal investigations.
- The information you have shared with others (eg Reviews, posts in the forums) may continue to be visible to the public on the Platform, even after the cancellation of your Account. However, the attribution to you of such content will be removed. Furthermore, some copies of this information (eg access registers) may remain in our database, but disassociated from identifiers.
e) Withdrawal of consent and limitation of the processing of personal data.
Where you have consented to Puglia and Pedala for the processing of your personal data, you can at any time revoke this consent by changing the settings of your account or sending a communication in which you specify which consent you want to revoke. We remind you that the withdrawal of consent does not affect the legitimacy of any treatment activity based on it before its withdrawal. In addition, in some countries, the applicable law may give you the right to limit the way in which your personal data are used by Puglia and Pedala, specifically if (i) the accuracy of your data; (ii) the processing of data is not performed legitimately and opposes you to the deletion of your personal data; (iii) Puglia and Pedala no longer need it for processing purposes, but request information to ascertain, exercise or defend your right in court; or (iv) you are opposed to processing pursuant to Section 6.6. below, pending the verification of the possible prevalence of the legitimate reasons of Puglia and Pedala on yours.
f) Opposition to the processing of personal data.
The law allows you to request Puglia e Pedala not to process your personal data for specific purposes (including profiling) where such processing is based on a legitimate interest. If you oppose this treatment, Puglia and Pedala will no longer process your personal information for these purposes, unless they can demonstrate legitimate reasons to proceed with the processing or if such treatment is necessary to establish for the assessment, the exercise or defense of a right in court.

g) Complaints presentation.
You have the right to complain about the processing of data carried out by Puglia e Pedala to the authorities responsible for data protection. The data controller for your data is Puglia and Pedala, which has the right to file a complaint with its lead control authority, the Italian data protection Commissioner.
